he is on unemployment and he has been out of work for Three months and he is a healthy man who could have gotten a job by now. He is ordered to pay $500 a month and he is behind $375 What do you think the Judge might do?

probably put him in jail, which is just about as stupid as it gets. you dont make much money in jail. cant say much, dont know your situation, all i know is what ive seen. women living good, the guy isnt. everytime he gets a raise, the support goes up. he gets a bonus, she gets half. theres no income tax refund, she gets it. she could probably get a better paying job, but why? she getting enough of his money. on top of the support, he buys school supplys, pays car insurance, ect. the whole problem with this is, once the court gets involved, you will have no say in the matter, no matter how unfair it gets. if hes a deadbeat, then what happens is probably warrented, but if you can talk at all and be reasonable, keep the courts out of it. a divorce is devastating enough to kids, battleling over money makes it worse.

well, if he was working and got laid off..and is now on unemployment..what would you expect the guy to do. if he is getting unemployment he has to report and show.. on paper atleast two attempts he made to get employment. do you work? he has been out of work three months.. has to pay 500 a month..that is1500 and he is 375 behind. hey that could have been much worse. i am all for fathers paying support..taking care of them children financially...and emotionally..but some moms are getting outrageous. feeding and supporting boyfriends on the dads..money...and a whole lot more,. it took two to have those babies... so i hope you are being fair... and he is taking his responsibilities seriously. if dad can show.. he is laid off until a certain time.. the judge just might lower his support. if it is just a case of finding a new job... he may not.

Depends on where you are, here in NE, the judges often say that the person has proven the ability to make a certain amount so get up off his *** and go earn it. But you're pretty lucky if he's only behind by 375, my daughter's dad is behind over 5000 and that's nothing compared to some people I know. Good luck and God Bless.

I hope the judge orders him to pay twice as much. It is everyones God given right to provide and take care of there childern man or women no matter what problems he or she is having. As a healthy man and able-bodied that should be the FIRST thing on his mind at all times. I am a father and have been seperated for about seven years of my ten year-old son's life and no matter what my ex and I are going through she knows that our son comes first and if thats the only thing we agree on then It's all worth it because every child in this world deservs all the love and support that they can get. Nothing angers me more then seeing people not takeing care of there kids the way they should. I hope you get youre support but I hope more that the father realizes what he's doing because he is just depriving himself of all the wonderful joys and blessings of fatherhood.

This exact thing is what my husband and I have been battling for the past 10 years!!!!!In our case we have tried to get the judge to lower payments because of alot of different reasons and the judge would never lower anything!!!We live in Illinois,and they are tougher on child support so if you live in another state you will probably be able to get payments lowered,at least the judge will hear your case.Make sure to bring all statements of income and if you two are married or if he has other kids will help to lower payments also.I hope this works out for you,so far it hasn't for my family and my husband pays about the same amount as your family and we have 3 of our own children to support also!It's not right!!!

The Judge might yell him that his child support will be lowered but that is not all....the Judge might allow him to postpone all child support until employment is found. This is the scariest thing he might play this unemployment card for awhile but remember that once he gets a job his checks will be garnished now he gets in a hole with child support more than 10,000.00 his license will be revoked, he will end up in jail, and almost lose everything. Just hope everything goes right for you!

Healthy or not jobs are not as easy to find as you think, especially a good one which obviously he needs to pay this outrageous childsupport (unless of course this is for more than one child)..

I wouldnt sweat it.. he might lower it temporarily, give the man so many days to get a job and have him come in for reevaluation. .. but it also depends on what state you are from...

Put him in jail for not working and paying his support. My sister's brother in law pulled this and was thrown in jail and he honest to God is shitzophrenic. It is well documented , he has been in and out of hospitals since 16. Attempted suicide various times because the voices told him and can only hold a part time minimum wage job when he works but the judge still threw him in jail for not working PT and paying his child support of 150 a month.

Ya know if this guy is a good father otherwise,why dont you give him a break until he gets back on his feet.thats not so hard to ask,just because hes healthy,who are you too determine whether or not he should have a job by now,maybe he's not been offered anything in his field of work.besides it wont be up too you its a court decision anyway.give the guy a break for cripes sakes.

Unfortunately for you, child support is based on what someone actually earns, not on what they could potentially be earning. It is possible that the court will temporarily lower his payments because of this lowered income. The unemployment benefits he is collecting would be considered income, but this is obviously lower than what he would be earning at a job.
