I was in an auto accident in Kansas, I was 12 weeks pregnant at the time and my oldest son 3 was in the car. A 96 year old women failed to yield hitting my vehcile from the side, both were totalled. My son had a busted lip, that was it, I lost the carliage in my right knee., Had to have surgery when I was 4 months pregnant as well as x-rays, MRI. I have been a nurse for 6 years and have always been warned of the risk of all those procedures when pregnant. I had to sign consents regarding my pregnancy and those procedures so the hospital would not be held liable. I had to have the surgery becasue I could not walk at all, without falling. I have lost my job d/t not being able to work 12 hour shifts anymore. My question is will my baby (unborn at the time of the accident) be compensated as well as my 3 year old son. Not trying to win the "Lotto" as far as a settlement, but worried about long term effects from the procedures I had done with my new baby.

All the actual damages and moral damages that you sustained arising from the negligence of the 96 old woman can be claimed in court. You just have to present evidences of all the damages and make a total of the amount to be claimed.

how can a 96-year-old be driving, I'd think the lawsuit could go far beyond her for heaven's sake, someone gave her a license again recently. Geez louise. She couldn't even know better at that age!

I'll pray that your baby is ok, though, that's the really important thing. Good luck and God Bless.
