I wrote a check for $500 to an acquitance of mine who said that he will fix my Plasma TV.
He took home my TV and brought back in 2 days saying that he would need an additon $500 to fix the problem. I got pissed and asked him to **** and then issued a stop payment on my previous check.
He is a small business owner but we have no contracts /aggrements on either side. He never issued a receipt for the cheque that I gave him.
Can he take me to small courts for the lost labor?

You paid him $500 to fix the tv. not carry it to his house and bring it back still broken. I would have stopped payment also. he didnt do anything.... so what labor could he charge you with? Next time carry the tv to the shop and tell them to call you with an estimate of what it will cost to fix it. Never give dollars first. If your estimates are too high it might be cheaper just to buy another tv. m

Does he still have your TV? It sounds like your friend is trying to rip you off. Since when does it cost $1000 to fix a TV? You should have taken it to a professional. He could possibly take you to small claims court but since you have no written agreement and he didn't actually fix anything he probably wouldn't win anyway.

it'll be your word against his. he has your check in hand and you have nothing. assuming he didn't fix the tv then you have your claim. $1000 to fix a $1500 tv? that's seems a bit much. could go either way but as long as you point out the tv wasn't fixed and you thought he was trying to rip you off for an additional $500, then you have your claim.

Its against the law to stop Payment on a check unless you have a pretty good reason

Yes he can and unless you can prove that no work was performed on the tv and he is just scamming you, you will end up paying him and the court costs

If there was no written contract, it would be hard to enforce in small claims because it is all verbal and he can say anything, but so can you. If he did, it would be his lost

YES!! Make sure you get a copy of the check or have it written in your checkbook somewhere. Your gonna need proof to get this loser!

If you put a stop on the check, then why do you worry?

Did he already cash it?
