This is crazy. I am on a contract with them for another 7 months. I can not cancel or they charge me $175. They will not honor our agreement as they say my plan is the same rate, this is just a "fee" and they can add "fees". WHAT A SCAM? Any attorney's interested in a class action suit? They want to upgrade me to a plan for $10 more a month with less than I currently get and refuse to keep my plan in tact for the full term or let me out of my contract. Can they legally do this?

It is not a GSM phone, but I just got it in Feb 2005. The problem with upgrading is that I lose my early nights and weekends, get less anytime minutes and my plan goes up $10 per month. I never use my minutes as it is, but if I stay on a plan at the same cost, I will go over since my nights and weekends will begin at 9 pm instead of 7. I finally got the bums to provide me with a $35 credit to compensate for the $5 per month until the end of my term, but it was like pulling teeth.

There is a class action suit going on against AT&T/Cingular. I don't remember the internet address, but type AT&T class action in your search bar and you will find it.
As for the old phone and early termination fees, I was charged an early termination fee when they wouldn't replace a broken phone. They wanted me to sign a two year contract to replace my phone so I cancelled. When they charged me, I wrote to the FCC and got it back.

I am also an old ATT customer and I've not seen a fee raise but I have had a problem as I need new phones and the ATT phones can't be added to their new system so you have to sign a new contract with Cingular instread of sticking with the generous ATT plan I had. I agree, this sucks. I will be paying the same amount but will have 9 PM evenings instead of the 7PM I have now, and I will lose 200 minutes a month! What a crock. I am not locked into a contract but they do have the best service in the area I am in.....I wish I knew what to tell you, I agree, it is bad business on their part.

Looks like this is because you are using an older phone not because you are an old AT&T customer. Are you sure you're phone isn't using GSM? I would think if you're still under contract with them then you have a newer phone . . which one would assume would use the newer GSM technology.

Thats part of the cost of converting to a newer networking technology. That fee is suppose to help convince you to dump that old AT&T cell phone using that outdated TDMA networking technology. Time for you step in to the world of GSM.

They own the network that you are talking on and within reason can do pretty much what they want to do.
