I work at a town camp, & I have a feeling I'll be fired the end of the summer, just because I guess im not liked (im nice to everyone, just intimidating I guess). They'll probably try to pull some excuse that Im too old or whatever (but there are people older than me working the camps)

The only thing they have against me is that "I" lost a child on the camp grounds [which are very small by the way], but that wasnt my fualt, & the blame was placed on me, because none of my other co-counselors owned up.

Since then, they've said that I "always lose my kids" (which is totally untrue, swear! I dont know how one time turns into always) And I've heard them talk about me "negativly" a few times

I like this job, close to home, kids are nice, it pays REAL NICE, i'll do whatever it takes to keep it!

PS- last summer, i sprained my ankle bad on the grounds on some uneven gravel [aka, not my fualt] & i wasnt compinsated, yeah, they still payed my salary, but no med. bills, can i use that too?

LORD Z- Out of all the counselors, ive been there the longest [3 summers], which means I get paid the most...so i have the most seniority there

If they fire you for job performance, they will have to have a lot of documentation for "coachings" due to job performance (specific). I would challenge them to why when/if the day comes and they inform you of being fired.

Having a lawsuit? I highly doubt it. If you try to pull in anything, I guarantee it will not look very good for you if they mention the losing of a child while you were in charge. Regardless of it being your fault or not, it was charged to you. I would have disputed it right then as opposed to allowing it to go on my record.

No company can fire you because they "don't like you". They can put a spin on it like you don't represent the image they would like a councelor to have at the camp (i.e. being approachable). If you intimidate the campers, that could be a problem for a camp councelor. If it's the staff that are intimidated, tough.

What I would do is ask to meet with your supervisor(s) and find out the deal. Ask them point blank if you're going to lose your job. If they state not, then tell them that you have gotten the feeling and would like to know what you can do to improve your job performance (a.k.a. - ask for feedback). You can't fix what's broken if you don't know what it is.

But back to your question - I don't think you have a lawsuit because of the lost child thing. They can easily cite job performance based on that incident alone. It would be a hard one to fight. . . Sorry.

Gather up all of your HR records.
Attendance, appraisals, reprimands, etc.
If you do get fired, I guess you could go get a free consult from a lawyer who will be able to tell you whether you have a case or not.
HR records will be required as evidence that you were a good employee. I'm pretty sure that they can't legally fire you for being to old, but I guess they could trump up some other excuse.
A worker compensation claim would only net you a visit to the doctor, and maybe meds, and treatment, and they would have compensated for lost pay.
You don't make out from a claim unless there is substantial, permanent damage. You'd have a hell of a time proving that an ankle sprain last summer has caused you much grief, or even that it happened for that matter.
Personally, I think that you should go talk to your supervisor and ask for an impromptu evaluation of your job performance. Ask them to be honest about what improvements must be made, and then do it.
Also, I'd quit reacting to the "you always lose your kids" comment.
Your reaction is why they keep saying it.
When someone speaks negatively about you, apologize and ask them to please explain to you what you've done. Don't be confrontational. Then accept their criticism, and promise to do better next time. You don't have to admit that you are wrong to validate their complaint. You can say "I'm sorry that you feel that way" or something similar, but do not try to defend your actions. Just listen, and validate.
Right now you are the "gang up on the outsider victim". Remove yourself from that role. Quit giving them ammo for the attacks. Blend in to the woodwork. Two weeks from now they'll be ganging up on a different outsider.

To begin with, I used to work for a park and I was the only person they kept after summer because they didn't need the rest. Maybe where you are working it is different. Generally, they only keep you if you are needed or have seniority or both.

As for losing a kid, that will only be a problem if they have a zero tolerance rule. Otherwise, it wil only effect your performance evaluation.

Next, you accident sound work related so i figure they would pay for it. Did you give them the bills? It is your responsibility to do so. My friend nearly had his foot chopped off by a riding lawnmor and they paid for that one. I figure a sprained ankle costs a hole lot less.

If they don't pay then itemize it on your income taxes.

Best advice I can give you though is to keep positive. Take a "What's next?" attitude with them. Let them know that you enjoy your job by constantly letting them know you are dedicated to doing your best. Actions speak louder than words

You shouldn't get fired over that, but they have other things they can make up to get rid of you. Just make sure that you are always on time, very sweet to the kids, and nice to your boss.
If the kids like you then there is a chance they will talk good to your superiors about you. They don't want to chance upsetting the kids.

You can't really take legal action for honestly being fired for ur"intimidation".You also can't use ur accidents in court cuz they'll argue that its not their fault you trip and they paid you during the time you were out.

If you're getting a paycheck and taxes are being withheld, you should have received worker's compensation for your accident. I they did not report your accident to Worker's Comp, they may be in a bit of trouble.
