Also, once taken, how hard is it to get it out of the truck yard, besides paying up what you owe,,,And I have heard it like $100 a day for holding the car...true?

No, when your sister financed the car, the agreement was to make the payments according to a schedule. If she defaulted the legal owner of the car (bank) has the right to take the car and hold it for payment and then if needed sell it. The tow truck driver only gets paid if he recovers the car. He has the written authorization of the legal owner to seize the car. When you finance the car you give up all rights when you fail to pay on time.

No this is not true. The tow truck drivers have legal authorization from the bank or the dealership that is doing the repo. A repo occurs when someone does not pay their monthly car note.

The contract signed by the buyer is a binding legal agreement to adhere to the terms of the purchase or lease contract. Failure to comply will result in a repo and that is permitted under law.

If you interfere with the repo man then you can definitely get arrested. Some repo men are licensed to carry firearms too so I wouldn't advise messing with them. The only thing the repo man cannot do is break into your garage to repo the car. A repo can only occur if the car is in the driveway or on the street or some other open location.

I don't know what the exact daily storage rate is but it will vary depending on where the car is stored. Yes your sister is liable for the daily storage fees too.

Tell your sister to pay up in order to regain her car.

Sorry, but it's false. The only way to stop it is to pay what you owe. My friend had the same thing happen to him a while ago and catching the tow truck driver almost got him a beating and a night in jail.

No, you can't stop the process if he is there to get the car. The reason he goes in the middle of the night, is because people have less fight in them in the AM hours. It is just easier for them.

The cost to get the car out of impound is usually paying what you owe, & the cost of impound, which is different in every town.

Paying you bills on time, or calling the company to work out a payment plan is usually a good way to avoid problems like this.

Her car was lying back in a state of being reposed? Like on a lounge chair? How odd.

Did you perhaps mean that her car was being REPOSSESSED?

Sorry, once the repo man has the ticket and finds the car, it's gone, whether it is attached or not. Not much you can do if you let it get to this state.

Even if you were to, say, call the police, the repo man could just show them the order to repossess.

no they are just contracted by the bank that financed the car even if you called the cops they are still allowed to take the car the only way is if you talk to the bank and pay the remanding balance on the car or the back charges and the towing fees

The loan contract gives the bank the right to seize the property. Interference with a repossession is a felony in most states.

Nope. If she gets a cool tow truck driver he may let you get your stuff out of it first but you wouldn't be able to stop it.

Nope, my brother in-law is a repo man.
If you give him to much guff, he'll just end up calling the cops and you get to go to jail ( if you act like a fool ) and get your car taken away anyways.
The only way to stop it from happening is to pay your bills on time.

once repossessed, it is the option of the lender to let your pay your full balance in order to receive the return of the vehicle, or pay the payments you are on behind on. Most likely they will want the full balance on the vehicle in order to return it. This can vary by state.
