I signed up to a 2 yr membership to a womens only gym, and 6 months later they went into liquidation, i cancelled my direct debit as obviously they were not providing the service I had applied for. Now they have sent me a debt collection letter with a highlighted section saying they have defaulted my credit record. I wrote them a letter advised by consumer direct, which they haven't replied to in writing, but i had them on the phone this morning with quite an aggresive tone, asking me what I was going to do, I told them I wanted to hear in writing, which they got more aggresive with. The 3 co's the gym, credit agency and debt collection all run under the same co, but i have contacted office of fair trading who said they are registered. Not sure what to do now....new to all this type of thing, any suggestions??? I hope this makes sense!!

if they have gone into liquidation they are just trying to bully you, dont pay anything, advise them you are seeking legal advice. if they are getting aggressive they are getting desperate, you are not defaulting on the contract, they did by going bust. stick to your guns, they are just bullies, cant you name and shame them on local tv or something?

go to the bank, and the citizens advice bureau. Get the legal run down from your bank on the legal aspects of the direct debit and how it protects you as a consumer. Then go to the citizens advice bureau to discuss the legal aspects of cancelling on an agreed contract where the other side has been unable to keep up it's side of the agreement. If you get any other telephone calls tell them that you are currently seeking legal advise and request again that they send you the details in writing. Also if you have a tape recorder at hand you could always tape the phone messages (some answer machines will do this) but make sure that you advise them at the start of the call that the call is being recorded.

They have broken their side of the contract. Contact the office of your local MP. How can they ask for money when there is no gym for you to go to? Thats what the office of fair trading and your MP will say for sure. You did the right thing cancelling the direct debit. BBC Watchdog or rogue traders or the Wright stuff.

Contracts are about give and take - if they're no longer providing the service, you no longer have to provide the money UNLESS stipulated in your contract that it can be transferred to another location. Read your contract carefully and if this is the case, pay a lawyer to write a letter to advise them to stop harassing you.

Go to the citizens advise bureau in your area, they sound like bullies who are out to get money for nothing. If they are not providing the service then THEY have broken the contract not you.

If they are making threatening noises to you - they could be guilty of harassment - which is now a criminal offence - if they make any further contact with you advise them you are reporting them to the local Police as they could be arrested for harassment.

Tell them you're not giving them any more money because they didn't handle previous funds responsibily. The must demonstrate good business practices to get back in your good graces before they start receiving your money again.
