There is no prohibition under the law to sleep in the car while on the parking lot.

Maybe the people answering this question could actually read it. The question specifies a "public" parking lot. So those of you who are saying, "No, it's private, it's tresspassing..." are missing the point.

You would also be doing the asker more of a service if you cited on what authority you give your answer. So the person who clerked in a court is doing a good job, but those of you who say, "NO IT ISN'T," aren't really being that useful.

The Wal-Mart tip is useful, if true. So again (and I am not the original asker): is it legal to sleep in your car if you are legitamately parked in a public space? (i.e., along a city residential street, or in a public lot, and/ or in highway rest areas.)

Believe it or not, it depends upon the parking lot.

Most places would consider it trespassing or loitering, however it's encouraged by Wal-Mart. Using Wal-Mart parking areas has been popular for drivers of RVs for several years; presumably because they park there, spend the night, do some shopping and are on their way.

We live close to a rest area and I was District Court Clerk for 9 years, I never once had a ticket turned if for court for sleeping in your car.

It is loitering, standing, or trespassing in most cases. Plus if you are in the front seat you need a seatbelt on. Ask permission and check for signs prohibiting any of the above mentioned offenses.

depends on the property and prob the time of day. Sleeping during the daytime will prob be ok anywhere, not at night. It is considered tresspassing on private property.
