How do you obtain Power of Attorney after someone has passed away ? State: California

no one will give me any info without this - is there anything else I can do ?

we did not go to probate - I am his daughter and there was not a Will. I am listed as next of kin on the death certificate......

The posters above are correct: You cannot get a power of attorney for someone who has passed away. The person's estate stands in for the deceased. If you need information, you need to talk to the executor of the estate. If the deceased had a will, the will would have named the executor. If not, the probate court will have appointed one. (If you are the executor of the estate, people should be giving you the information you need when you prove to them that you are the executor. I don't know what document does this in California.)

You have to get power of attorney BEFORE they pass away

You can't. Someone gives that to you by signing the paperwork before they die. Depending on the relationship, the state might be able to grant some rights.

what if theres no executor of the state i talked to a lawyer for he says I would be the next of kin but have no proof what can I do.

you don't. power of attorney is for living people, not dead ones.
