The brochures contained info about the business (similar to what is seen in hotel lobbys). There was not a sign stating that you could only take one brochure. The brochures were just sitting on the the counter of the business.

You need to be put away for life you brochure taker! Nah, I don't think the police will arrest you for taking brochures.

The business can put any limits it wants to on how many things it gives away for "free". They should probably have a sign that says "take only one", but I doubt they "have" to have that sign. Their verbal warning to you is enough. If you go beyond that, it could be considered theft (though I doubt you would be held liable for any restitution- unless the court gives them the costs of printing new ones). They can also say "get out". If you don't, they'll get you for criminal trespass.

Depends who's threatening you and the nature of the threat.

For the most part a threat is covered under the 1st amendment of the constitution.

I don't think it would be a criminal act, but if your intention was to stop others from seeing and receiving this advertising, there could be a civil suit.
