HIPPA: Health Insurance Portability and Accountability Act of 1996 applies to any entity that is a health care provider that conducts certain transactions in electronic form, a health care clearing house or a health plan. I'm assuming that since the prison has a health care provider and there records are kept in some sort of electronic form that they are covered under HIPPA. Check this website out: http://www.hhs.gov/ocr/hipaa/

I'm not sure why you would need your brothers medical information but you could call the prison back and ask them how and if you can obtain that info. Power of Attorney applies to everything in his life so I'm not sure that he would sign that over to you.

HIPAA applies to every health provider of every sort. You can't just call up a place and get information on a person. You have to have the patient's permission in writing on file at the place you inquire. So why not ask your brother?

My agency works with people in the criminal justice system, including prisons.

HIPPA applies ALL health providers and info gatherers (doctors, health insurance, hospitals, health spending accts, medicare, etc). Since you called the prison to ask about his health, they shut you down. Prisons have their own health systems, by the way, so the same law applies.

You would need to find out from the prison if you can get permission from your brother to get info about his health. He probably would need to sign something.

Or, ask him to send you a letter letting him know how he is, assuming he is not so sick that he can't do that.

I save sowing love and compassion yet I save harvesting anger, injustice, hate and indifference. No your analogy would not artwork. The ameliorations do not come like that, in a stunning trend, they could surely in no way are available a life-time's length. those words are only an hardship-free thanks to appease the ego and provides you it desire in a likely hopeless international. the fact despite the indisputable fact that is way bitterer than that. many human beings available are reliable hearted and they continuously get hardships jealousy, animosity and mess united statesin their lives. I mean the right party of all of them and which thoroughly disproves your idea is JESUS. look at it for a second. Jesus changed into the embodiment of love, he surely sowed helpful ability and emotions round him and look at what he were given in go back!!! What did he harvest? A "tremendous" crucifixion!!! The worst and maximum humiliating style of lack of life for the time of that aspect period (Roman era). If that would not convince that your analogy is incorrect...i do not comprehend what's going to. besides to, to say that sowing hatred will deliver us hatred ability that we shouldn't do this and that i imagine it truly is particularly unrealistic and selfish. If we were no longer meant to sense hatred in this international, hatred does no longer exist. it may in no way be experienced. we may be organic souls without negativity yet we are no longer and for this reason we are the following and in no way on yet another measurement. adverse emotions exist b/c they are needed contained in the grand scheme of issues. we ought to continuously no longer view them so negatively. they are our publications as a lot as helpful emotions are. no longer something in creation is ineffective or 'undesirable'. each thing is reliable and has a objective. so that you may not reject adverse emotions. they are an element human beings and we ought to continuously befriend them, no longer circumvent them. The better you circumvent them, the better they attitude you and demand to be heard. So it may surely be the option of what you're keeping: "once you do not sow hatred, you harvest better hatred"!!! because you ignore about it and refuse to settle for its existence and recognize it for being what it truly is and taking area in its ideal position in this fact we are residing in.

Nope, it's for all medical-related information, whether its your pharmacist or the hospital or the prison.

Your brother can sign a paper allowing you access.

HIPAA is there to protect individual privacy...have your brother sign something authorizing you to find out about his health

You brother could give you Durable Power of Attorney, and you could then find out, also, your brother could sign waiver allowing you to have access to his medical records.
