My co-worker and I were making some jokes, anyway something came up that I really wanted to know, but I honestly don't know for sure. Say a 12 year old, has a kid (and yes it does happen today), when she has that baby is she the actual legal guardian of that baby, or will her parents be the legal guardian until they reach age 18, or something else?

The 12 year old would have legal custody of the child. The grandparents could petition the court to give them guardianship over the child and would most likely win considering the circumstances. However, were the parents of the 12 year old really be responsible parents themselves? Their daughter did get pregnant at a very young age. I know my daughter is only 12, and there is no way in this world she will be left with that much time on her hands. Nor with such a diluted sense of the realities of sex in this day and age.

That 12 yr old would be the legal guardian of that child. The grandparent could be declared the legal guardian if the 12 yr old has some mental or physical disabilities that would prevent the child for caring for her baby. Other than that, legaly because she gave birth, she is the one legally recognized as the guardian.

Ethically parents, legally parents. How can she be a considered a legal guardian at 12, not until recognized as legally mature in civilized countries and if not then they (the parents) should be held responsible, or social and domestic governmental services. Age 12 is not legal, it is her child, but guardian, how... especially since she has parents as you stated.

Look I am unsure but I asked a question the other day to my boss
(an attorney). I wanted to know if my son was to get a girl pregnant if I would be the responsible party for child support. My bosses answer was you are responsible for your childs actions. So you can take it for what its worth..........

As far as your question goes I figure the state would have to provide funding for the child if the grandparents do not. But I honestly don't see how a person with no way of taking care of herself could ake care of a baby.
