i'm pretty sure they are. i just watched an interview a couple days ago where he says how hard it is to be apart from Kate when they are working.
and everytime an entertainment show mentions the box office, they talk about pirates, then they go to superman and say something like 'orlando's girlfriend kate bosworth'

yes, they are cause he was interviewed by Extra! stating that Kate and him were still together and that they hardly ever see each other. How it's so hard communicating when they both are in a different country/far away.
