has anyone here faced a summary court martial ??
i am pending this charge in the army and i am wondering if anyone else hads gone through something like this. I have done alot of research and i know all of the punishemnts, I am beng charged a dwi and misuse of government property that exceeds $500.00 another key point is i that i have been in the militar for 5 years and these are my first offenses, would this help any during the trial?

I have been a witness at an Air Force general court marshall. A clean record prior will help. A sharp defense counsel will help. The proceedure is pretty cut and dried, and yours will be even more direct. Make as good an impression as you can, and sling no s***, the judge has heard it all, probably a white haired Colonel with 1/16" long hair. Keep excellent military bearing, and a super high and tight haircut. Since you opted for summary, saving gov't money, you may get a break, and just lose a stripe or general under honorable conditions, which the American Legion or VFW can get upgraded to honorable by snapping their fingers. I'm surprised they are heading in the direction of SCM with this one unless your misuse of govt property was a doosey! The DUI usually isn't too bad a deal with having to go to detox school and classes... perhaps even an anabuse tablet every morning for a few months... SO... deopending on the govt property thing, I wouldn't worry too much. I'm guessing a bust in rank, extra duty and a fine at the most.

And BTW... get some help! You are representing all of the military everytime you do something stupid in public!!!

Thank you for serving in our military. This isn't really a good place for legal advice. You might luck out though, I hope you do. In any event, get some good legal advice from a military lawyer or someone else like that. Good luck.

but the good news is you cannot be tried for something twice, was it on or off post...if off the military cannnot punish you for something the civilian gov punished you for, they have to think up something else....so that could be worse
