We chose a floor plan option that had never been done by the builder. After starting construction they realized they would have to greatly reduce the size of a walk-in closet to make the necessary changes. We specifically chose the upgrade because of the enlarged closet. I would not have chosen this house if I knew it would turn out the way it has. They never even offered to get our input on the changes to be made. They just changed our house and expect us to be happy with it. What can I do?

If its drastic than pull out and seek a lawyer. If you can live with it than use it as a bargaining tool to get some more upgrades but they pay. Hey get the backyard lanscaped with grass and concrete. Get some upgrades in kitchen or bath area. Be creative if you still want the house. If you dont than walk away.

What did the builder say when you asked him about it? What would make you happy? A refund of your deposit money? Getting something else (free upgrade) instead of the closet? If the builder if uncooperative, seek an attorney's advice. Builders want to sell you the house, not have you back out of the deal. Also, put everything in writing to the builder, send it certified mail etc.

You need to contact your lawyer and see what your rights are. I am too in the middle of bulding a house and it is a very frustrating process. If you chose that floor plan for a specfic reason, and then they changed it, you should be able to stop construction and get your money back out of it. After all the company did forfiet the contract by not building what you originally signed the contract for. I hope everything works out and good luck!

Your contract probably says that the builder reserves the right to modify floorplans, or something of that nature. You wont get your earnest deposit back if you signed a contract that says this.
