If she is drunk and not in a state of mind to consent to sex and he "takes advantage" of it that is legally date rape. I am not talking about a few beers and being embarrassed the next day. I am talking about I cant walk, talk, drive, or think type of drunk. It can land your friend in jail and its very wrong. If you know damn good and well that a girl would not comit to having sex with you if she were sober but go for it anyway that is wrong on all levels. Your friend is an asshole if he did that. I dont want to hear the she had it coming exuse. We all have a little too much too drink at some point but that doesnt give people the right to sexually abuse you.

The best thing to do is drive them home. No mater how cute or sexy they are, they might,not even rember you .Tell them you cannot be around people that drink like that or at all. I do not know how old you are but keep a level head..Pem

do you mean have sex with them, because that is illegal in some states, irrelevent to his/her age, because while under the influence you legally cannot give consent to have sex.
i would never even be interested in someone if he/she were drunk at the time, i dont like drinkers
