We have only been late 3x and only by 3 days max. There is oil from a car on the drive but the car isn't fixed yet so why fix it now, we'll fix it when the car is fixed. Also he rented us this house with sidding missing on 1/6th of the house and 7/8ths of the gutters missing so the water runs into the basement. Does he have any grounds to evict us? (I already put over $600.00worth of repairs not to mention sweat and time into this house.. wev'e only been here since April, 2006)

why waste your money fixing someone else's house? he has a right to charge you for the damage to the driveway... seriously, it sounds like you shouldve taken a clue when you saw the condition of the house, and found a different place. from past experience, renting from a homeowner has been horrible to me, but renting from a management company has been awesome. get out of there asap and plan on kissing your security deposit goodbye... you might want to go to your state governments website and see if they have a pamphlet on renter's rights... when i moved from MI to CA, my landlord screwed me out of my security deposit because i didnt give him a forwarding address within 7 days (i was still living out of a hotel)... educate yourself on the laws BEFORE you get into a situation like this.

You don't mention where you are, but he or she can sure try.

Where I am, the landlord can evict for late payments if the tenant pays late three or more times within a year AFTER being properly served with a Notice To Cease Late Payments, and three prior late payments would need to be documented and included in the Notice.

That being said, being late by 1 to 3 days would not be taken into consideration seriously by a Judge here, unless it was every month or almost every month.

Personally, I think he or she is talking tough right now to scare you because they don't want to have problems getting their rent.

Why did you rent a house with such serious defects? Call the housing inspector if your landlord refuses to make the necessary repairs.

Why are you spending money on "repairs"? Your idea of repairs could be his idea of "damage" and you could lose your security over it.

Probably, the guy probably knows what he's doing when he had this lease written.

Quit putting money (you say $600) into the house and just pay the rent with it.
Pay on time. If you just moved in in April then that leaves May, June, July now Aug. - you've been late most every month. The guy is probably getting pissy with you because he's worried this is off to a bad start.

Sounds like you shouldn't have rented from him in the first place because he is a slum lord. I was in a similar situation and I moved quick before it costed me an arm and a leg. But if he signed a lease with you he can't evict you. Not only that but most places give you a five day grace period to pay your rent. Although if he is willing to let you out of the lease I would move because you don't want to live in a house that gets flooded out. Mold grows in water. It could be potentially unhealthy for you and your family. This is one of the causes of serious illnesses. Good luck.

sure he can. why did you put all that money into a house you was renting? He should have made the repairs. I guess you should get your deposit back since you paid out stuff.
renters dont need a reason to evict you unless there is a lease and being late can be in your lease. he prob wants you out so he can up the payment since you did repairs.

Yes. If it happened 3x, the landlord is probably sick and tired of it. You were foolish to make repairs. That is the landlord's responsibility. There is no way you will get anything for it. If the house was damaged, you shouldn't have rented it.

Oil on the driveway is fixable, the landlord has to pay his mortgage. 6 months and your stuff is out on the lawn and im not joking.But it sounds like hes a dirt ball landlord, and if everybody pays him 3 months late he dont have the money fix the place up.So you have to walk a mile in his shoes.

It depends on your lease. If you have a lease on your house, then re-read it and check to see if there are clauses there that cover what you're talking about. If you're renting month to month, then I would go talk to a lawyer and find out what he/she thinks.

It is possible. But really, why is it so hard to pay rent only THREE days prior? That is not a big gap.
