If someone is 17 (18 in about 6 months) and they volunatrily leave with someone, is it considered kidnapping? Shouldn't they be able to make the decision on their own? And can their parent MAKE them come home?

Kidnapping generally requires some degree of force, usually physical. The term in Missouri (and many other states, I imagine) is lack of consent. Generally, a minor cannot legally consent due to their age. On the other hand, a 17 year old is considered an adult in most states for criminal purposes. If a person is considered under state statute to be legally able to give consent, the "kidnapper" hasn't really kidnapped them. If that person is mentally handicapped or mentally ill, or under the influence of drugs or alcohol, regardless of their age, they are not legally capable of giving their consent. The key word in your post is "voluntarily" and I don't think under any federal or state statute a 17 year old who voluntarily goes somewhere with anyone has been kidnapped.

NO, it would not be considered kidnapping. Considering a 17 year old has the mentality and capability of knowing he/she is voluntarily going with a person, the other person could not be charged with kidnapping.
The elements of kidnapping are generally as follows.
A person must take a person against his/her will from one place to another while trying to conceal their location. What you described is not kidnapping more likely a simple juvenile runaway. The parents cannot make them come home but the police can. A person under the age of 18 is considered juvenile and must remain in custody of a guardian until the legal age of 18.

Yes. For the next 6 months, not a day before, you are still under their care.
Look at it this way. If you are babysitting a child, and the child wanders off outside, 6 minutes before the parents are to be home, the parents are going to ask you where that child is.
So will the police.
It would be considered kidnapping if you actually know who the child went with. Then they would charge the person that took the child.

Well, if you are under eighteen you are still considered a minor and your parents are still your guardians. As far as the kidnapping, If you took someone that was against there will, who was under eighteen then it would be considered kidnapping. It seems like you took your girlfriend away from her parents, if that is the case, and you are over eighteen and took a minor under age away from there parents, being voluntary or non-voluntary, it could be construed as being kidnapping...Just a guess if that is what is going on...I would suggest you remedy the problem and do the right thing. Good Luck...

It won't be considered like a kidnapping but like a run away. And yes, since you're a minor, your parents can make you come back.

If there's a ransom demand, it's kidnapping, otherwise it's abduction.
If you "run away" with somebody of legal age and you're not, they're liable for many many charges.
If you're of legal age and "run away" with someone who is not, you're the one liable for the charges.
Wait a few months, eh?

It would not be considered kidnapping . Your parents could not bring you home if you were to become legally married or become emancipated.
