I know the law varies from state to state but, if a funeral home listed the wrong spouse on a death certificate are they required to correct the incorrect information? Or do they have to be court ordered to change information even when; an affidavit was sent to them with the correct information from a law office that got the proof that someone gave false information and indeed was not the spouse from Probate?

In Arizona it would require an Order from the Court to change the Death Certificate. An Affidavit would not be sufficient.

no answer, but maybe call a few other funeral homes and pose this question to them. Also, maybe a probate attorney or a long time employee of the probate court system. Just start calling people and try to gather some information

The way the funeral home is looking at this is they were given their information by a family member who should have known the correct name. (Hopefully, this was the case) If they placed incorrect information without any one from the family's input, then they should want to make the correction before being sued by the family.

Go back to the law office and have them petition the court to change the name on the certificate.

THE FUNERAL HOME DOES FILL OUT THE CERTIFICATE I THINK THEY ONLY ACT AS THE MIDDLE MAN SOUNDS LIKE YOU NEED TO CALL THE STATE OR COUNTY GOV.
