There are two causes of action under the common law. The first is called "alienation of affections" (means pretty much what it says. The second is called "criminal conversation" (which means having sex with another person's spouse). Many, if not most, states have repealed alienation of affections as a cause of action, but criminal conversation still remains valid in many states. You'd have to check your local statutes to see if it's been repealed.
These common law tort actions are seldom used nowadays, but you still may have a cause of action if you really want to go that route.

It's possible to be sued for alienation of affection. Hard to prove though, because they have to prove that the marriage was fine before the affair. Check the laws in your state.

Yes. The beautiful thing (possibly sarcastic) about the American legal system is that anyone can sue anyone for anything. Not saying they will win, not saying a court won't even throw it out on first glance - but you CAN sue.

My attny. told me that is no longer possible. The law system got rid of that ability back in the 70's or some time after.

I don't think they can be sued but I know if one or the other is in the military they can get in some serious trouble for adultery.
