No one in America in this day and age can possibily be unaware of the dangers of drinking and driving. So, being aware that you could kill somebody, and taking the chance anyway - would you call that attempted murder? Do you believe that with MADD and other organizations fighting this cause so diligently, that one of these days it might actually be a reality?

Attempted murder? No. But I wish we'd at least start treating it with the seriousness it deserves. The slap on the wrist people get just isn't enough.

if they do kill someone, it should be called murder, and not manslaughter, but there had better be damn good proof that it was the drink that caused it, 100 percent caused it, not contributed which is a judgement call. There are also different degrees and situations to think of, someone that had a glass of wine with dinner and drives home along a deserted road is a little different than the drunk with two fifths of whiskey in him doing a hundred thru town. Im not saying that either is good, but some people do handle booze better, and other things can be just as bad, such as driving while tired, that has been proven to impair just as much as drink.

No. I think attempted murder implies an intentional attempt at taking a particular life, or at the very least inflicting serious harm. If one simply gets in their car and drunk drives, they are not taking a direct, intentional action against a person.

And what percent of drunk drivers kill someone? I bet it is in reality a moderately low percentage. So simply finding someone drunk driving would not necessarily mean you found a murderer. Or even someone likely to kill someone.

A noble idea, but I agree with J P. I believe attempted murder means you plan to kill a specific person(s). Drinking and driving is irresponsible, and the chances of killing someone are huge, but it will be hard to prove in court that it was attempted murder.

You could kill someone everytime you get on the road, drinking or not. Most states have pretty tough DUI laws now. I think attempted murder is going a little far.

Murder is when someone intentionally kills someone. I don't think that's the case with drinking and driving. People don't drive around looking for someone to run into. It is an accident caused by their own stupidity, but not intentional. I think it should be vehicular man slaughter. Maybe they could attach stiffer sentences when alcohol is involved.It is heinous, and tragic. But I don't think it's murder.

Maybe attempted voluntary manslaughter. The line is so thin when you try to define the word of the law. Murder requires proof that it was planned and intentional, not accidental or "spur of the moment".
