If this man's name is on the lease, there is nothing you can do legally to get him off it. However, if you live in a leased dwelling and he's NOT on the lease and the landlord was NOT informed that he would be moving in, you might be able to get the landlord to help you out. Lease agreements usually have a provision for landlords to evict tenants if they fail to inform the landlord of another tenant moving in. If this is the case, and you get the landlord on your side, he/she could say that an eviction notice will be issued unless this man moves out within 30 days. That may be enough to send him packing. Maybe YOU should move. If he's on the lease I don't know of a way he can be removed. Why don't you talk to him? At the risk of being obvious, you knew him well enough to have a son with him. Communication is the key.

If he is on the lease then he has as much a right to the apartment as you do.

I take it that you can't just talk to him?

Are you married? Are you ON the lease?

Its not clear to me if/what the fact that he is your son's father
has to do with anything other than you may want to keep the
arguing down...

If you are married to the man file for divarce, if not file for sole custody. Either way should make the point that he isn't welcome.
