The cookie stand is up stairs the food court is down stairs. It's not like were talking quantum physics here.

Whether it's located in the Food Court or not... I'd say it's a part of the Food Court. Just like a coffee shop.

Do you have to display a license to sell food and beverages.
Are you inspected by the Health Dept.
Do you not have to throw out or discard leftovers.

Then, you my friend, are a part of the Food Court.

That is just in case you need a snack when on the other floor. YOu have to go all the way to the food court for a full meal.
