My exhusband smokes around my children, even though our modified decree states that he is not supposed to. I want to write a letter myself to his lawyer to state that he need to stop this. Would this be adivised or should I hire a new lawyer to take care of this?

Anything you say will be used against you by an ex's lawyer. They will try to twist your words into pretzles... get your own lawyer. Who knows, some activist groups may have lawyer members who will help pro-bono... just a thought.

Writing a letter to his attorney will, most likely, do nothing. It is highly unlikely that the attorney will even bother to pass the information along to his/her client. The letter will probably just be tossed into the file. And quite honestly, unless there is more to this, it is not worth taking back to Court. Most attorneys want at least $500.00 for contempt hearings, and you are still not guaranteed that your ex will not keep doing what he is doing. Sorry.

I would have a lawyer handle this. This is something that needs to be documented so if it does end up in court, you will have followed the appropriate steps.

Unfortunately, you may be wasting your time, because no body will be around to actually enforce the request. He's only doing this to upset you and the kids shouldn't be put in the disagreements you two have. So, your only option is to ask him nicely and hope it works. He may surprise you. Let him know how this may be affecting the kids because they can't say anything for fear of getting him upset or hurting his feelings.
