Hi,

My cousin is going through, yet another, custody battle with his ex-wife. He had sole custody of his two children, however recently he decided he would let his children visit their mom (his ex-wife). Now she has threated not to return them, gotten a temporary custody order, and is taking him back to court.
She has called in the Children's Aid Society and falsely accused him of abusing his children. To make matters worse she seems to be manipulating the kids into wanting to stay with her with gifts, taking them out to dinner every night, and letting them stay up and basically do what they want. What kid wouldn't want that? Any advice for my cousin?

Get a good lawyer. The children need to be seen by a doctor immediately so that they can be check for possible signs of abuse. Temporary custody is just that. Temporary. If she tries to coach the children, a child psychologist can usually spot signs of this. The best defense is a good offense. Tell him to make sure that he has evidence backing up any claims he makes against her. If the children are old enough, he can find teachers and school nurses to back him up in stating that the children are not being abused in his care. Best people to testify as to his character would be a pastor, leader of a civic group (like a member of VFW or similar organization), teachers. Never have someone testify that you wouldn't use as a reference on a job application. Good Luck to him!

Personally, I know this sounds really harsh, but let the case take its course.

If he hasn't abused them at all, it will all come out. He needs to fight it, but if she wins, then she wins. She will be the petty looking one in the end, and I know for a fact that those kids will grow up to resent her. Yes - kids respond well to getting what they want, but when she needs to be "mom", she's going to have a hard time. And when the kids find out that their mom manipulated them (and they always do), they will resent the hell out of her. She will lose in the end.

It sounds to me like she is being petty and using the kids to hurt her ex because he made her angry. What a pathetic mother. I sure hope he wins.

be more careful with who you make babies? If he is innocent of the charges, it will be figured out. The fact that he had sole custody before will be counted. It's too bad that the kids are caught in the middle.

Your cousin needs to find an 'attorney's attorney' (i.e., an attorney who represents other attorneys) relative to this type of law. Good luck!
