line 50 page 1 in discloseres ask was you known or has there been any infestations of insests pests problems. My answer was no because I had no knowledge of any problems. There suing me because they think I had knowledge of a problem. They are suing me for bat removal and replacing insulation so far I learned that there are alot of homes with bats and replacing insulation is very unheard of. so it's small claims court. If anyone has any feed back I would like to hear some before court tomorrow afternoon aug.1 Thanks!

You are being sued for what they call a "latent defect". That is a defect in your home that you sold that you had no knowledge of. You are not responsible! You will not be found negligent, but the court may ask you for some of the compensation to correct the defect. You're not guilty if you didn't know! Your realtor is your best witness! Didn't you fill out a disclosure statement before marketing the house? Don't forget a copy of that in court, your best defense. Good luck!

Didn't the bats show up during the professional home inspection the buyer had done?

You may want to check into case law in your area. I'm sure the issue has come up before.

P.S. There is no such thing as "guilty" in small claims court. It's a civil court, not criminal.

You mean insect pests ? If so, this sentence is not at all relevant in your case. Bats are not insects so the sentence does not apply.

paperwork is key. if you have any idea of any they may have you should look for some yourself to counter-argue whatever they bring to the table. It could just be some measles trying to make a few bucks. 10 months is awhile and you have the disclosure proof. It should be fine.

aren't bats protected? I thought you couldn't remove them.

Could be a problem here if you ever mentioned a bat issue to your old neighbours.
