does it matter how old the movie is? who do i pay? any current websites with information? if i serve free food and drink - will the cover charge be applied against f&b.

I think it is illegal also. If you use a movie to draw in paying customers, even without an additional charge, you are using copyrighted material to induce people to come to your restaurant and therefore make a profit.
You need to pay the copyright holder -- unless the movie is in the Public Domain.

I found this website which claims to have movies and stock footage in the public domain - http://filmchest.com/films.php
I know nothing about them, so be careful, but this is the kind of site that might help.

Contact the American Society of Cinema, or check with the reference section of your library. You might get around this by not charging cover fee, only asking for donations. But I would ask a lawyer.

Even if you show it for free you have to pay royalties.
