If you are really serious in taking legal action first find a new job then do it.
You are right according to Labor law you are suppose to get break. This happen often, but people continue their job without complaining because they know after filing a complain they can not work in the same company. Are you ready for that.
Then go to your nearest labor office and consult but before that keep record of time card or any proof that your employer did not allow you break.
According to my experience when you need a proof no one from the same company will come forward and you will be alone. So think twice before you act.

You should consult a lawyer. Every 4 hours you work, you're entitled to a 15 minute break and if you work I think it's 6 hours, you get a lunch or dinner break of at least 30 minutes. Talk to a lawyer....it may differ in each state as far as the number of hours, but you are still entitiled to a break and lunch.

I feel your pain. I used to work 10-hour graveyard shifts at a gas station. When I raised the lack-of-break issue, I was basically told that I am expected to take my break during non-busy times without clocking out, therefore lucky you- you get paid for your lunch break! Try not to feel too bad about taking extended cig breaks and toilet breaks! Just lock up before you pop out!

I work at Kangaroo and we don't get no breaks and what is worse is we are the busiest in all of Florida and we are nonstop 24 seven on our feet no chance to even grab a drink is this wrong?

that would be a good lawsuit.
see if anyone else is having the same problem as you are. it's likely that if your employer is shafting you, they are doing the same routine on someone else.
if yes, a lawyer will pick this case up in a heartbeat.
you will GET PAID for it.
it's called CLASS ACTION and it's a good lawsuit.

how many times do you get a chance for a break? if there are slow times these are your breaks and it is probably more than if you had scheduled breaks at least that is my experience in that job field.you should be grateful for your job .you would be wasting everyones time and money trying to sue someone nice enough to give you a job.
