Some of the huge titles, such as "Harry Potter," do get a midnight release, but those are notably at stores that don't stay open 24/7. There are indeed contracts regarding putting things like CDs, DVDs and books out early - a store can be fined or lose distributorship of certain things if they violate those rules.
Chances are that the superstores play it safe by waiting until 7 a.m. - and, to play devil's advocate, they do have other things they need to do in the store. When I worked at Blockbuster many moons ago, we prepped the shelves ahead of time, but didn't put out the new release titles until we locked the doors at midnight.

The wall mart in my home town yes a super center will sometimes go get it out of the box for you but they have them on the shelves by 1am

When there was a Media Play you could. And you got a party with it...Ah, well. All good things must end.
