She can ASK for anything.

However, she is not legally entitled to court ordered
child support until a court reviews it and makes a
pronouncement on your mutual finances.

Generally, a husband and wife's finances are considered
the same (community property) until a divorce - That is to say,
you both own the money.

However, in practice, you may have signature authority
on some accounts and she may have signature authority
on different accounts. That is, you may be keeping her from
accessing some of the money - however, as far as I know,
her only legal remedy is divorce or to petition the court
to show that you have abandoned your child (or at least
the support of it).

In any case, why are you two screwing around this way?

This is an issue that is so fundamental to the way that
married people interact that I am extremely surprised it
in itself doesn't CAUSE a divorce.

From here it looks like you are using the child as a way
of preventing the divorce, and that just isn't right.

Not 100% sure what the law is in IL but usually if you guys are separated (but not divorced) she can still get child support. esp. if you are not adequately taking care of your kids.

Keep a record of everything brought and given, if that is the case. Do not give cash, give cheques or by standing order, so show you have been doing something...what you can afford.

Yes, I just spent years in Madison count courthouse getting rced and a ndivoasty custody battle. I am the mom but if your wife asked for it then you should send it because she can collect back support plus you would not want her to tell the judge you didnt take care of your dauter because you will see it doubled and youll have a blackmark plus she can make you look bad to alot of people its not good if you look like you dont want to help your child.

If they go on welfare, the state will automatically go to you (non-custodial parent) to repay any amount they give to your family (custodial parent and children). If you pay other than that, keep receipts, etc. You should be at least trying to care for your kids. If you are worried about custody issues, make sure you get a lawyer to straighten out any custody questions along with child support questions.

Yes she can if you dont live togather and she has the children. you need to fight for joint custody.I live In IL. and I have full custody of my kids.But always take care of your kids keep all receipts.And never give her cash always a check or money order write on there for child support.If you can keep it out of the courts fine.If not you must pay if you dont once it gets to a certain amount they will issue a warrant for your arest

Yes but she shouldn't have to ask you should be a man and give her the support "YOUR" children need! DAMN you men piss me off! They are your children to! Oh sorry, how often do they stay with you? If it is not half the time you need to be giving her money! BTW I dont have children so I'm not mad about that! You should be paying half of the childcare, half the food, half the rent, half the electric and utilities, and half the laundry soap and other such needs!

If you have a kid you shouldn't have to be asked for support. Helping your child is the right thing to do.

If you're not living with her, then yes she can ask for child support, she can even take you to court.

If she doesn't live with you, then yes, she can. My sister in law doesn't live with her husband and he's paying child support for their little boy. So, yes, she can.

well if you are not living together yes she can.i had a baby and his father and i were still seeing eachother and after i had the baby if i didn't move in with him they were gonna start taking child suppot with him.if the father and mother don't live to gether then she can go after you for support
