I was arrested for a D.U.I last Friday. I KNOW im innocent, I pretty much no I was not illegally intoxacated. However, If for some reason my blood test comes back even one percent over the legal level and I have pleaded innocent. What will happen if I am found guilty. I already know I will have to revoke my Liscense, and do 48 hours in jail and D.U.I class, but will there be a penelty on top of that for pleading inncocent, and vicea versa, If I plead Guilty and the results come back that I was not legally drunk, What will happen after I pleaded guilty? I made a bad choice. But please help me if you know.

you should not plead guilty to a crime that you may or may not have commited. Pleading guilty results in sentencing regardless of the blood alcohol test says. The best bet is to plead Nolo Contendre (spelling) which means you are not going to say your guilty or inncocent and its up to the judge to hear the case and make his decision. That way all the evidence will be heard and you will have a chance to tell him that you did comsume alcohol, but that you dispute the fact that you were drunk. You will, of course, get your license suspended for a period of 6 months or so, youll be given a pretty big fine, and also required to attend the DUI school and youll be placed on probation until your fine is paid off. As far as jail time, if you already spent the night in jail, or however many hours youve already spent will be deducted from the mandatory 24 or 48 hours in jail. Good luck. You should talk to a lawyer that gives free consults and read up on the Nolo plea. Its worth it.

The first question is how old are you? The next is what state are you in?
In Texas if youre under 21 and you have any detectable amount of alcohol in your system your wrong and your guilty.
Now if youre 21 or over there are a lot of shades of gray...If you took a blood test and the results come back showing you were intoxicated then that doesnt automatically mean you are going to be slam dunked.
If you have a clean record then they will take that into account...if you want to strike a deal with them without going to court then they will probably do that too...

So you KNOW you were innocent. Is that because you were stone sober? I'm gonna guess not.

Face it, you were drunk, and you still got behind the wheel. Take it like a man, and plead guilty. And stop driving drunk, @sshole.

Plead nolo. That basically means you will not admit quilt, but for the judge to show mercy. You will get probation, fines, community service. and have your license revoked for one year. If this is your first, you may get a special permit to drive to and from work and school.

You are innocent until proven guilty. They don't make you do anything else. Look at the Mass Murders, they all plead innocent they don't get put on extra "booty patrol" because they are found guilty. Did you ever see Shawshank Redemption" They are all innocent.

With D.U.I.'s in most states your guilty if the cop says you are there is no way out of it. It's the cops word against your and you will lose. Sorry.

I do not know what state you live in and the laws are different in most states.But the very Best answer is to get a lawyer who specialty is DUI.This is something you need to attack head on,no joke intented.It will come back to haunt you,and you need to clear your name and keep it clean.PLEASE DO NOT DRIVE WHILE DRINKING!!THE LIFE YOU SAVE MAY BE YOUR OWN!!

If you have any doubt, then obviously you had been drinking, or you wouldn't be worrying about it. You now have to face the consequences.

Hope you don't repeat this mistake when they finally give you your license back.
