U.S. District Judge Sam Sparks said that if he adopted the Republicans' argument, then either political party could change candidates after a primary election merely by declaring a candidate ineligible based on a move.

"This would be a serious abuse of the election system and a fraud on the voters, which the court will not condone," wrote Sparks, a Democrat appointed by Republican former President George Bush.

Texas law allows a political party to replace a candidate if he or she dies, becomes medically incapacitated or becomes ineligible for office. If the candidate simply "withdraws" from the race after winning his or her primary, a new candidate cannot be chosen.

NEW ORLEANS - A federal appeals court panel on Thursday refused to let Texas Republicans replace Tom DeLay's name on the November congressional ballot.


A three-judge panel of the 5th U.S. Circuit Court of Appeals upheld a ruling by U.S. District Judge Sam Sparks, who said in July that DeLay name had to stay on the ballot even though he quit from Congress and moved to Virginia.

DeLay won a March primary before resigning from Congress on June 9. He is awaiting trial in Texas state court on money laundering and conspiracy charges alleging that illegal corporate cash helped pay for legislative campaigns in 2002.

Republicans want to pick another nominee to face Democrat Nick Lampson in November. Democrats sued to keep DeLay on the ballot. Keeping him on the ballot gives them the opportunity to make the indicted former House majority leader their symbol for claims that the Republicans are corrupt

Wouldn't being on trial or awaiting trial be considered an illness by republicans or perhaps just an party-occupational hazard.The so called neo cons are the same as the old cons to me ,same breed different name.
DeLay is the poster boy for the republican party.
I'm very glad this political maneuver was squashed.There are still some people with balls in Texas.
That's a 11 on my scale.
I wouldn't be surprised if DeLay got a lot of republican votes ,after all they are use to having criminals on the
republican ballot,and have no problem voting for another one.

What this says to me is the Democrats are afraid they can't beat anyone BUT DeLay. I don't have a problem with Dems wanting to force the Republicans to run DeLay or no one. It's using the rules of the game to your advantage.

What would be ironic is if DeLay is forced to be the candidate of the Republicans and he won.

10. What will be interesting is how many votes he gets. Obviously, some people like having voting districts rigged in favor of Republicans.

I don't know how this will turn out but if its Texas it should be interesting.
when I lived there the politics were wild and I see it hasn't changed much.
