The definition of Rape is a sexual asult the the vic did not give con cent too. If you never said yes to sex then yes it was rape. The law is not supposed to take in to account and previous actions in the vic part.

Can someone be held responsable for something that happened to them will they were sleeping?
I have 2 sleep disorders and a pos. R.E.M disorder that prevents me from waking up and I was taken advantage of as i was sleeping, but I am the one charged with the crime, and I don't see how you can be resposable for a crime that you are the victim in

Yes is rape.
Probably, but as far as getting a conviction, a good lawyer could cast a shadow of a doubt on the case convincing the jury that you were with such person, and passed out while on the act, because of your giving condition.

Yes it is!!! You were not awake to give your consent. So then it was sexual assault with out consent. Which is the basic definition of rape. And even if it was not legally wrong, then it is morally wrong. What kind of person would have sex with someone who was unconscious?

It is rape if one person says no or is not capable of making the decision to some sort of impairment ie: alcohol , drugs , unconscious. Also if they are too young to make an informed consent to sex.

If you have a bonifide sleep disorder, were you seeing a doctor? Did he not testify about your condition?

Yes, it is rape and you need to contact your local police department. This person is not going to stop, unless you do something. Most women do not report rape, for the fear of exposure- don't let that go on!
