If yes, can I request a duplicate file to take with me?

I'm not positive, but I think it's a law nationwide that you are allowed to see any file an employer keeps on you.

Yes they must give you all information pertinent to your file unless such information is also linked to a company trade secrets,formulas, investing etc. information. Any info with you name attached to it that is a part of a companies trade scret can not be shared abyway. You win both ways. The federal law has a requirement under FERPA( acronym may not be exact bu t close) that mandated this effective in all states . It is the same law that protects your personal information, medical information and other such. I have practiced this right for 15 years. I have used it in IN, IL, MI an OH. Companies are shocked when someone actually asks for this so be pushy and demanding. If they are non-compliant then contact the States Office or the Attorney General where that company resides.

In CA, yes, you can view and get copies of everything **you signed** in your file. Anything you did not sign you do not have a right to view or receive a copy; however your employer may allow you to anyway. Your employer must comply with this within a "reasonable" timeframe, and they can decide what that is (24 hours, 1 week, etc.).

Depends on the law of your state, and who the employer is.

Some states consider an employee's file the employer's property. However, with employers like the federal government, one may obtain a copy of his personnel file.

You should consult a lawyer in California who specializes in employment law.

Absolutly! If they can right things and put things in a file about you, You have every right to know about it. It's your right as an employee, to know and understand what has been written baout you that got you to the place where you are now. How could you ever better yourself, or know that you are doing a good job?

Yes, you can see your file and you can get copies of everything
that is in your personel file. Nothing is supposed to be put in
afterward that you do not know about or signed off on.

I got fired in Massachusetts and got to see my file.
