You should tell him first, but still get him one maybe several so he'll always have a "back-up" fish. Depending on the fish, some of them like the company of other fish anyway.

Fish die. I would be nice for you to replace them, but fish do not live for an extremely long time, unless your brother has koi fish. Just tell him they died, who knows, maybe he is tired of the fish.

How old is your brother? If he is young maybe you should. If he's older be honest about what happened and ask if he wants another one.
