Is there an alternative to cutting the root (which would almost certainly kill the tree)? Can I cover up the root with gravel and/or blacktop or will that also kill the tree? Also, what are my legal rights and liabilities? (The tree is on my neighbor's property.)

The root is on your property and is prohibiting you from the legal best use and enjoyment of your property. You can remove the root if you want to, and you certainly should prior to installing a driveway. If you do not, the root will eventually damage your driveway.

You might want to talk with your neighbor about the situation, but ultimately, the decision is yours.

Ugly situation. Contact a tree removal service, a paving service, and your neighbor on all of this.
