Technically..the HOV signs don't really specify living or dead passengers..

Usually there are other cars following the hearse, so it would not drive in the carpool lane anyway. If they let the hearse do that, could anyone with a box of ashes do the same?

The driver of the hearse may drive in the carpool lane, when carrying a stiff. Who's gonna complain?

Traditionally speaking, other cars follow or pull over from a funeral procession as a sign of respect. The hearse leads. Usually, there is a police car to assure that all runs smoothly.

It depends which state you are in; In Virginia, Pennsylvania, Ohio, Idaho, Hawaii & North Dakota, legislation has been passed to include "deceased persons" as legitimate passengers. In Texas, North & South Carolina, and New Mexico, there is specific legislation barring the use of a cadaver to gain access to "HOV lanes". But in all the other states, the matter is up in the air.
