we were seperated at the time i applied for a loan to refinance my house and now may be reconciling before loan process is finished. he has never been on the deed, title or other loans. even though i told the loan office that we were seperated, the loan says that i'm single. is is legal not to mention this before closing?

If the loan is only in your name, and the title as well, it will make no difference on the application if you listed as married. Since you are married, and not legally separated, correct it.

Depending on your state of residence: If you were living in the home as a principal marital residence and you are now reconciled, your husband may have to sign the mortgage. Mortgage companies get very touchy about anything that may affect the lien.....Please ask your loan officer or settlement agent about this.

You should be fine - if you want his name on you can do a Quick Claim Deed after the fact and his name on the deed, but he will not be on the mortgage. Why not wait 6 months, and see how things work out - In case it does not - than you do not have to take his name off the deed (again)....Good luck to you - and hope things work out for you both.

What state are you in? This can affect how you take title to the home.
