In most states I know of, underage sell is illegal. However, I have found no laws on my own that address underage smoking of tobacco. Now twenty or so years ago, I almost was picked up in the state of Nebraska for underage smoking, so that state might have something on the books about it.

It is illegal for minors to buy and sell and use tobacco products. If you get caught it is a misdemeanor.

No it is not true, a minor can be charged for minor in possesion of tobacco just the same as they can be charged for minor in possesion of alcohol.
