You got hurt on their property. It's just that simple.
Pardon me while I go into my little song and dance to celebrate for you........

We're in the money, we're in the money;
We've got a lot of what it takes to get along!
We're in the money, that sky is sunny,
Old Man Depression you are through, you done us wrong.
We never see a headline about breadlines today.
And when we see the landlord we can look that guy right in the eye
We're in the money, come on, my honey,
Let's lend it, spend it, send it rolling along!

No, the only person you can "sue" is the 300 pound woman who pushed you.
The chair was operating properly as you can attest that it moved with you, and did what it was designed to do.
The escalator was moving the right direction and it was unfortunate that you fell, because of the chair, but, it did its job in moving in the right direction.
The Store can not be responsible for what others do, simply because they make bad decisions and it impacted you. (If that were so, they would only let one person in at a time and have 12 people watching that person like a hawk until they left and another was let in)...
So, your only beef is with the overweight woman who seemed to have something against you, and wanted to see bodily harm come to you, and I would want to know what it was, so that you both could work it out. That was tantamount to murder if you would have died in that accident.
I wish you well..
Jesse

The mall wasn't negligent in this situation so no, you can't. It's your own fault for putting yourself in potential danger by sitting in a rolling chair close to an escalator. But, it IS also the girl who knocked you down the escalator's fault. This is in no way the mall's fault. It's your stupidity and the girl's carelessness that resulted in this accident. Darwin called this natural selection.
Stop trying to screw people out of their money. I, for example, worked at Best Buy years ago and my manager choked me. I didn't sue them because, while I was pissed, there was no real harm. I did get him fired, but that's different. You shouldn't go around trying to get money anyway you can. It's unethical and wrong.
Judging by your other questions, however, you're full of sh*t. What a worthless piece of crap. Some people in this world are so stupid, you're a perfect example.

Any recovery against the store would have to be predicated on negligence. This sounds like an intentional act by a third party which the store could not have anticipated. In most states, the store is not an insurer of your safety. They are only obligated to remove hazards of which they are aware. The issue is whether or not this incident should have been reasonably forseeable by the store owner. This would be a very difficult case to establish liability. If they offer anything, I would take it.

No. Gravity pulls you all the way down to the floor plenty speedier than the speed of the escalator. you may take a touch longer yet you need to both fall each and each and every of how down or supply up on between the steps counting on how your weight is transferring at the same time as your falling.

earlier a badly misinformed and humourless person wrote :-
"Some people in this world are so stupid, you're a perfect example. "
am i alone in thinking that the perfect example of stupid people are those who totally miss the humour that this question and others like it are posted with. Do I really have to explain how Imacorndog was in fact taking the piss out of the countless number of fraudulent / stupid injury claims that are raised every year.
god whatever happened to humour and common sense ?
Incidentally, the keyboard fell on my foot whilst typing this, it has traumatized me, now do i sue Imacorndog, Yahoo, or IBM as they made the keyboard ?

why do that ? even kids know how to pick themselves up after a fall, no one will be able to remember your face or how you fall or when you fall, a week later from that incident. Com'on nobody is waiting for a comedy or a joke from you, don't have to embarass yourself hiding 3 hours in a toilet. You can be a better person if you are less obsessed with yourself.

And how is it the malls fault that you were stupid enough to fall down an escalator? What the hell kind of generation is being raised out there. You did something stupid, and there was an accident. Take responsibility for yourself. Jeez......

Sorry you couldn't find the "fat chick." She's the one responsible, not the store.
