Specifically in Nevada. We have previously found documentation that states a public school can NOT be a 501(c)(3), yet now can't locate that information.

A 501(c)(3) is an IRS designation for an entitly to be tax exempt. Most charitable foundations have this designation. It does state that educational organizations may qualify except for "instrumentalities" - yet that was difficult to understand, however I think a "public" school is an instrumentality. Thanks!!!

The PTA (Parent-Teacher Association) can be a 501(c)(3), in other words, a non-profit or charity type group. I doubt that the school can be, since it is essentially a government agency.

A 501(c)3 is a not for profit, non-profit entity. You might take a look at the documentation that was filed with the IRS. It might really be a 501(c)7.
