this time i go and show the judge that i already moved out, will he cancel the eviction if i already moved??

How can you be evicted if you're not there? Eviction means to get someone out of a place.

I do not mind paying the rent, i just don't want an eviction on my record. My lease is up in August , which is today.

In order to attempt to anwer your legal question, I would need to know what state you're in. However, tf you are willing to pay the rent that your landlord wants in exchange for the eviction not being on your record, why don't you simply contact your landlord's attorney and offer to pay that amount in exchange for a dismissal (make sure you get a dismissal WITH PREJIDUCE)? No matter what state you are in, you can always settle out of court.

Your lease is your legal promise to pay the entire year of rent. Whether you do that over a period of 12 months or 1 month, does not matter. You promised to PAY your landlord for the lease decreed amount, not time.

On the same note, you are promised to be ALLOWED to live there for 12 months, even if you pay your rent in only 1 month.

I had a case where I paid my whole lease in one month. The landlord tried to evict me (under false accusations) and keep the leased amount. I took him to court and I won back twice the money I paid and the landlord was put on a 5 year probation for corruption.

If an eviction notice was granted, there must have been a compelling reason (rent owed,damage to space, too many complaints about parties, etc.) Your decision to leave doesn't affect the reason for the complaint and the order should stay on your record as a warning to future landlords unless you can resolve theoriginal issue.

If you were already moved out, what would the purpose of an eviction be??? I would definitely go before the judge and clear up this matter.
