I went to work at the seaside as an entertainer organiser in Italy, I worked 10 days. I departed on the 27-06-06. While I was there I got a phone call offering me a better job I accepted. I phoned the agency to tell them I had found another job and wanted to leave they then said I could not leave I had signed a contract and would have to pay them a fine of 4000.00 euro. Anyway to get to the point I never wrote a letter of resignation it was all discussed on the phone that I did not need to pay any money they had found a replacement I came home but now I having trouble getting paid the weeks wages. What should I do?

In the contract the fine was only 200 euro. 15 days notice period. The agency however found a replacement the same day I phoned to tell them I wanted to leave. The agency said they would pay me but seems they are fobbing me off as I was meant to get the money today but never got it.

Unfortunately I think it's unlikely that you will get your wages, in future check contracts carefully for awful clauses like this - you have been robbed, if you can be bothered with protracted court action for a week's money then you might get paid in the end but it'll probably be more hassle that it's worth. Sorry, employers like this are scum.

a fine of 4000 euro? my árse. You were not in slavery that you had to buy yourself out of.

agencies will filibuster in an attempt to pay you nothing.

Is this a UK company? If so the chances are higher that you will get something.

Your best bet may be the small claims court. Costs are low, the process is supposed to be simple, and if the other side doesn't show up it's deemed to be a finding in your favour. I've never done that but it might work.

PS My guess is that if the 4000 euro fine is in the contract then it is an unfair and therefore unenforceable condition. I'm no lawyer though. Do you have a friendly one who you could take out for a beer?

What's the name of the company, by the way? Name and shame. Anyone who puts that in their conditions of contract is an irredeemable bástard. May they drown in their own cess (or better, someone else's).

A fine like that is unlikely, but there may be a smaller penalty. Without seeing your contract, I cannot answer Yes or No, because it depends on your contract. The agency is possibly entitled to retain your salary as you did not follow their leaving procedure. Also you agreed that you did not need the money.

Check your contract, consider the amount, could you write it off? If you go to court, you have fees to pay, and it could take a bit of time. Consider your options, and make your decisions.

Sorry my answer is a little vague, but without knowing the conditions of employment, I can only generalise.

Cut your losses. Don't make a fuss because they could get funny about the 4000 euros. Just think of it as a weeks free holiday in Italy! Can't be too bad.

It depends on your contract. If it was in your contract that you would have to pay a 4,000.00 Euro fine, then thank yourself lucky that they are not chasing you for the money!
