the reason why i want to know these details is because i need a loan or a re-morgage and i would like to know how to get the claus lifted,as i cannot get any of the above please can you help me by giving me some information on to lift the claus thank-you garry gott

I'd think it depends on what type of clause is on the house title and the reason your daughter put it on in the first place.

If it's a lein, meaning your daughter loaned you money, other's are then made aware that you don't own 100% of the home's value and that might influence you being able to get a refinance.

I'd suggest you go to your potential lender and ask for their input into the clause and it's possibility of you not getting a refinace mortgage.

Other than that, go see a lawyer specializing in real estate and get professional help.

I presume you owe her money. Once she has a 'charge' on the property (that's what it's called) only she can remove it by you repaying her then she completes a form and sends it to the Land Registry (in UK). You can't remortgage because if you got rid of your current mortgage then your daughter's 'charge' would become the first one and no lenders want to hold a second charge on the property. They all want first charge. I can only suggest repayment - but use a solicitor to make sure she completes properly the form to remove her charge.

I think you better explain more clear about the clause and also if that's your house, how did your daughter put a clause on it?

The easiest way to do is to tell your daughter to delete it.

Clause? I think you need to explain a little better what you are saying. Did someone file a Lien against your property?

I cant see how anyone could put any sort of legal clause onto someone elses property without their knowledge or consent??

What clause has she put on it? If you are the owner she shouldnt have been able to.
