it is always out of the water on this boat and whenever i put him in the water he kicks water at me and gets back up on the boat

This may be a stupid question, but are you sure it's a water turtle?

A turtle needs to be able to dry out his shell on occassion. That is why it's important to have a heat lamp as well as the boat. Otherwise he could get a fungus or a disease that causes his shell to go soft.

1. Turtles don't like to be handled by giant predators like us.

2. The water may not be to the turtle's taste- it may be dirty, too hot or cold, too small, etc.

some turtles are aquatic and some like to be dry so maybe ur turtledoesnt like to be wet ..i mean it does need water but not all the time

My turtle is full of piss and vinegar too.
I've noticed that they are very independent, so just let it do what it wants. Mine wants to stay in the water 24/7, so I just let it do that.

Don't let your turtle take advantage of you. show him who's boss. Take him out and spank him, not too hard, and send him to bed with no desert
