I have had them he did 11 months in prison and another 12 months under intensive supervision release for domestic violence and he has had them about 4 months out of the last 4 years but can i get papers without them in my possesion

you need to go to tha library and read up on it, or go talk to a lawyer. cuz i know in texas, tha law is very strict when it comes to children

You can't. Usually these things are pretty set, (especially if you are a female who does not get custody in the first round.) I can't tell if you are a man or a woman from this question. Just make sure you always see your kids according to your visitation arrangement. Let them know you will always love them and will be there for them. A sad statistic: After 3 years, about 50% of MEN loose all contact with their kids after a divorce. For women it is less. Do not let this happen. By the way, in many states the kids can CHOOSE who they want to live with when they reach the age of 14 (sometimes this is 12 if the parent is remarried.)

You don't. You have to file a motion for custody through the court. After you have done that and the judge has ruled in your favor, then you can take them and there is nothing legally he can do.

If your ex is a parent, I doubt you can get them back without papers. You need legal documentation to show you should have them.

you may not want to do this but if they are abusive call child protective services and prove that they are abusive the children will go to you if they are or get a lawyer and go to court and prove it yourself,,and document everything until then. and how did he get them to begin with??

get the papers then take them back. or offer to have them on mondays wednesdays and every other weekend. that's what i do. my parents are divorced.
