was the damage caused as you alone went through the area, or was the stone or whatever thrown up by another vehicle. If by another vehicle then you will have to claim off that driver, who may well have been ignoring the speed suggestion. Were you doing more than 20 mph, because that is the usual speed suggestion in those circumstances,. How long after the resurfacing was it, as AFAIK, the council HAS to sweep the road surface 24 hours after the resurfacing

Were you following the speed limit and adhering to the caution signs when driving through the new surfaced area?

not unless they hadnt put signs up telling you the road was being resurfaced and even then you would have to prove it

If you can prove that you adhered to all the signs and kept to the speed limit then yeas you can but be warned they can be very stubbon. Go to your local CAB they will help you.

I would certainly try, if you can prove that you were not at fault in any way. I mean disobeying signs, etc.

good luck, i had my car bashed by a council van and they said i needed evidance,camera footage, so basically i was buggered
