You don't need a neighbor's permission since the fence is on your property. However there are other considerations involved. Some subdivisions have "Deed Restrictions" against fences of certain size or type. Also your local "Building Department" may require a permit, and may also have restrictions and requirements that you will need to follow. "Good fences make for good Neighbors".

Given your spelling of "neighbour" I assume you are British or Australian. It is always a good idea to discuss with a nieghbor anything you plan to do that will affect his/her property. Explain why you desire a fence, and get his viewpoint. Depending where you live, there may be zoning and permit laws concerning fencing. For example, where I live, fences may not be higher than 7 feet, and the fence posts must face toward the house. the fence must also be located a minimum of 8 feet from the street, and 4 feet from a common property line.

Depending on where you live you may be required to get a fence okay'd by your cities counsel. We live in a subdivision that doesn't allow fences unless around pools to protect any one from wander on over and being drowned. You also need to make sure that you are off the lot line enough so that you are able to maintain the area on the other side othe fence, that is not your neighbors responsibility. If you have no restriction to fending in your area then I would definitely ask your neighbor.

It might save ill feeling if you ask your neighbour first.

You need planning permission for a fence above a certain height and some properties have covenants restricting the size and type of fences.

Your city probably has by-laws governing the height of the fence. Some may govern the type of fence as well.

Since your neighbor will be sharing your fence it would be polite to at least inform them of your plans. At the same time you could inquire if they would like to share in the cost.

You should check with the *Planning" department of your local authorities to see about the hight restrictions in your area. Apart from that, it is good to know that only one side of your fence is your responsability if you have neighbours on both sides, so find out whos is what before building any walls ! And even if the side is yours to build on, it may be nice to let your neighbour know out of courtesy.

Check your local zoning officer for height restrictions. You need not obtain your neighbor's permission. In fact, some people put up fences so they don't have to deal with their neighbor. Giving a neighbor, essentially, veto power over your fence has it exactly backwards!

You don't really need the permission from neighbours. What you need is permission from authorities. However, if you are a good neighbour, you may inform them and explain to them your reasons. It may not make you a good neighbour, but it's the best you can do to maintain a good relationship.

Don't forget to check with your municipality as well. I think some states require the neighbors on both sides to split the costs, too.
The township may may also require you to set back the fence a certain number of feet from your property line.

No you don't need your neighbors permission and no you can't put up any size you like. Most place require a permit for anything over 6 feet high.
