No and I am wondering why the biological father is not paying child support. Unless he is passed away or in prison then he needs to at least monitarily take care of his son. Tho your husband did the right thing and treated your son as his own it is not his responsibility to take care of him when you two are divorced. Not even cool to ask him to.

Not if he isn't the kids biological or legal father no. Hopefully he'll still spend time with him though. My son was more devestated when his step father of 10 years disappeared from his life (he became a drunken drug addict) than when his dad and i divorced.
