Her Dad and I never married but he pays court ordered support( he pays when he wants and how he wants so it is never the right amount) I am currently married to another man but that is soon to be history and I can't afford to live in that state anymore some friends are moving to another state and have offered to shelter me till I get back on my feet. We have no papers stating custody but the Support papers lists me as the custodial party and we have NO court ordered visits only support.

He sees her whenever he feels like it. Other than his scarce support he does nothing else for her. I take her to school and pick her up and take her to her extra curricular stuff.

This is absolutely not the place to get sound advice. Go see a lawyer immeadiately....the other people who responded that said this are right too.

If you were never married and there are no court documents giving him rights/custody you ABSOLUTELY can move out of state without his input. Until he files through the court for visitation/custodial rights-you are the custodial parent because you were never married.

a lawyer that knows the state laws on child custody is your best bet...... you may can find something on the net about it.... crossing the state line is a touchy issue in a lot of states.... unless the father does not realy care you may get a kidnapping charge..... not sure about it tho... I do know that if one parent moves over 100 miles that parent has to make sure the child gets within 3o miles or so of the parent that has visitation, or at least that is the law here in my state..... so check it out to protect urself and your child......... If you don't have court orders for visitation or that forbid you to leave the state, you're probably fine.
You should be able to get an answer without costs from your child support enforcement agency..or legal aid.

the only reason i am asking is that every child needs a father... especially if he/she has a father that wants to see them... regardless of whether you are recieving child payments from him or not... really they are two seperae issues
i would seek legal advise.... but also work out future implications this may have on you and your child... is there a chance your child could be unhappy... sometimes leaving isnt always the best thing... havea huge think about it before you make any decisions...

if i were you i would ask an attorney and find out what the law is in your state. in california i have to have his written permission to even take them to vegas....let alone move to another state...so if i were you i would find out first before you act....if he says yes its ok then get it in writing and notorized ok :) protect yourself
